These Terms of Service (“Terms”) govern your access to and use of apexsupply.us and any purchase you make from Guilty (“Guilty,” “we,” “us”). By using the Site or placing an order, you agree to these Terms.

1.Eligibility

You must be at least 18 years old (or the age of majority in your state of residence, whichever is older) to use the Site or make a purchase. By using the Site you represent that you meet this requirement.

2.Store & Products

We sell apparel and related merchandise. We strive to display products and pricing accurately, but we do not warrant that descriptions, colors, pricing, or other content are error-free, and we may correct errors, change products, or update pricing at any time.

3.Orders & Payment

All orders are offers to purchase and are subject to acceptance by us. We may refuse, limit, or cancel any order — including suspected fraudulent or entry-farming orders — at our discretion. Payment is processed at checkout through Shopify’s payment systems. In the event of a pricing or typographical error, we may cancel affected orders even after an order confirmation.

4.Shipping & Returns

Shipping is governed by our Shipping Policy and returns by our Return & Refund Policy, each incorporated by reference.

5.Acceptable Use & Fraud

You agree not to misuse the Site, including by using bots or automated tools, initiating fraudulent chargebacks, or interfering with the Site’s operation or security. Violations may result in order cancellation and a ban from future promotions.

The Site and its content — including the Guilty name, logo, text, graphics, and design — are owned by or licensed to Guilty and are protected by intellectual-property laws. You may not copy, reproduce, or use them without our written permission. Guilty is not affiliated with, sponsored by, or endorsed by , of North America, LLC, or their affiliates; all third-party trademarks are the property of their respective owners.

The Site may contain links to third-party sites or services we do not control and are not responsible for.

8.Disclaimers

The Site and products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

To the fullest extent permitted by law, Guilty and its members, officers, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site, or the purchase or use of products. Our total liability for any claim will not exceed the amount you paid for the order giving rise to the claim.

You agree to indemnify and hold harmless Guilty from claims, losses, and expenses arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

11.Governing Law & Disputes

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles. Any dispute will be resolved individually (not as a class action) in the state or federal courts located in Connecticut, and you consent to their jurisdiction.

We may update these Terms from time to time. Changes are effective when posted, and your continued use of the Site means you accept the revised Terms.

13.Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
